                        The Land Acquisition Act, 1894 (Act.No.1 of 1894 as amended up to Act 68 of 1984) (2nd February,1894). 

                         This is an act to amend the law for the acquisition of land for public purposes and for companies and for determining the amount of compensation on account of such acquisition.  This act may be called the Land Acquisition Act,1894 which extends to the whole country except the State of Jammu and Kashmir. 

                        In the Nayagarh  District the Land Acquisition Section started functioning since June,1996 after bifurcating from the mother District Puri. The Land Acquisition Officer, Puri has transferred 141 nos. of cases and files which includes only 17 continuing cases.  The accounts relating to Nayagarh District has not yet been transferred. 

                        So far 69 Land Acquisition Cases have been started on the basis of requisition received from the Executive Engineer, Irrigation Division, Minor Irrigation Division, Khurda/Exdecutive Engineer (R & B) Division, Khurda and Executive Engineer P.H.Division, Puri for acquisition of private lands for public purposes.  Out of these cases 31 cases have been finalized and possession delivered to the Requisitioning Officers after payment of compensation money to the land losers.  Similarly, 31 cases because invalid by the Government in Revenue Department, Orissa due to want of Administrative Approval and placement of funds by the concerned Requisioning Officers and Administrative Departments within the stipulated period.  Now 07 cases are pending for action.

                         The present stage of the balance 7 cases are follows:

Govt. in Revenue Dept. have issued declaration u/s-6(1) of the L.A.Act. The Executive Engineer, Irrigation Division, Khurda has not yet deposited the sanctioned estimated cost for which the fund availability certificate could not be sent to Govt. for issue of orders u/s-7 of the L.A.Act.

The Executive Enginer, M.I.Division, Khurda has deposited the sanctioned estimated cost Govt.  In Revenue Department have been requested to issue orders u/s-7 of the L.A.Act which is yet pending at Govt. level.  Soon after receipt of the above order steps will be taken to disburse the compensation money to the land holders.

Kanasingi

Notice u/s-12(2) of the L.A.Act was issued thrice to the awardees but they did not turn up to receive their ward money.  As per provision contained in section 31(2) of the L.A.Act, a reference has been made u/s-18 of the said Act to the Court of Civil Judge (S.D.),Nayagarh with the undisbursed award money for disposal as per law.

Notice u/s-12(2) of the L.A. Act was issued to receive their compensation money.  But in the meanwhile the Executive Engineer, M.I.division, Khurda and Asst.Engineer, M.I.Sub-Division, Khandapara have requested the L.A.

Collector, Nayagarh to stop the payment work as the alienation of canel is required to be changed in both the villages at this belated stage.  No suitable steps have yet been taken by the Executive Engineer, M.I.Division, Khurda to regularise the matter.
